At the request of EPA , “one period of 6 continuous minutes in any 60-minute period during startup, shutdown, or malfunction” from the visible emission standard has been deleted. In order to articulate the Department’s enforcement discretion and to be consistent with EPA guidance, a section has been added to establish criteria and procedures for raising an affirmative defense. |
